What types of consumer disputes are there?

Consumer disputes occur when there is an issue with the quality of goods or services provided by a business to a consumer.

For example, if a fridge only lasts for 2 years then breaks down, the supplier might say that the repairs are not covered as their warranty period has expired. We say that the lifespan of a fridge should be at least 6 years, and the business has supplied a fridge that is not fit for purpose. In this case, the consumer is entitled to compensation under Consumer Law

I have been refused a refund, is this legal?

This depends on the circumstances for seeking the refund. If there is no issue with the product or services then the Australian Consumer Law will not assist you. On the other hand, if you purchased a product and it is different to what you sought to purchase in appearance and finish, then you will be entitled to a refund.

Do I report a consumer dispute with the ACCC?

You can, but they will not assist you with your dispute and the enforcement of your rights against the supplier.

Are there different consumer laws in each state?

No, Australian Consumer Law is a federal act and applies to all states.

How long does it take to finalise an outcome of a dispute?

This is difficult to predict, as it depends on the attitude of the supplier of the goods or service. We will look at your issues and then determine the best course of action. We have a pragmatic approach when determining the course of action you should take.
